Policies

OGF Intellectual Property Policy

All statements related to the activities of the OGF and addressed to the OGF are subject to all provisions of the OGF Intellectual Property Policy which grants to the OGF and its participants certain licenses and rights in such statements. Such statements include verbal statements in OGF meetings, as well as written and electronic communications made at any time or place, which are addressed to:
  • the OGF plenary session,
  • any OGF working group or portion thereof,
  • the Open Grid Forum Board, or any member thereof on behalf of the Board,
  • the Grid Forum Steering Group, or any member thereof on behalf of the Grid Forum Steering Group,
  • the Advisory Committee, or any member thereof on behalf of the Advisory Committee,
  • any OGF mailing list, including any working group or research group list, or any other list functioning under OGF auspices,
  • the OGF Editor or the GWD process
Statements made outside of a OGF meeting, mailing list or other function, that are clearly not intended to be input to an OGF activity, group or function, are not subject to these provisions.

OGF's IP policy is aimed at protecting the rights of individuals and organizations contributing to OGF specifications while minimizing undue licensing burden on developers and implementers of OGF specifications. OGF works on a "contribution" model. That is, when a person or organizational representative contributes an idea to a specification, it is that person's responsibility to indicate any patents or rights owned on that contribution. It becomes a matter for the group to decide whether to include that contribution based on the terms of license on that idea. At the beginning of each OGF group, the following IP Policy is stated to ensure that all present are aware of its enforcement.

Additionally, the OGF Board is responsible to determine licensing terms prior to the publication of specifications containing patented (or otherwise claimed rights) contributions. Generally speaking, OGF operates on a "Reasonable and Non-Discriminatory" license term model rather than a Royalty-Free model, though those terms are also acceptable. This is defined more precisely in the following excerpt from the OGF Intellectual Property Policy:

"Where the Open Grid Forum knows of rights, or claimed rights, the Open Grid Forum Secretariat shall attempt to obtain from the claimant of such rights, a written assurance that upon approval by the Open Grid Forum of the relevant Open Grid Forum document(s), any party will be able to obtain the right to implement, use and distribute the technology or works when implementing, using or distributing technology based upon the specific specification(s) under openly specified, reasonable, non-discriminatory terms. The working group or research group proposing the use of the technology with respect to which the proprietary rights are claimed may assist the Open Grid Forum Secretariat in this effort. The results of this procedure shall not affect advancement of document, except that the Open Grid Forum may defer approval where a delay may facilitate the obtaining of such assurances. The results will, however, be recorded by the Open Grid Forum Secretariat, and made available. The Open Grid Forum may also direct that a summary of the results be included in any Open Grid Forum document published containing the specification."
